These Terms of Service (the "Terms") govern your access to and use of the SnipeWins website, dashboard, and associated services (the "Service"), operated by 5 Star Card Shop LLC ("SnipeWins," "we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
You must be at least eighteen (18) years old and a legal resident of the United States to use the Service. By using the Service, you represent and warrant that you meet these requirements.
SnipeWins is a software-as-a-service tool that monitors public eBay auction and Buy-It-Now listings for sports trading cards, computes estimated market values ("MVs") from recent eBay sold-listing data, and provides users with suggested target bid amounts. The Service is informational only. SnipeWins does not bid, purchase, or sell any cards on behalf of any user. The Service is not affiliated with, endorsed by, sponsored by, or otherwise connected to eBay Inc. or any other marketplace.
SnipeWins may add, modify, or discontinue features at any time without notice.
To access most features, you must create an account using an email address and password (or by signing in with a third-party identity provider such as Google). You agree to:
SnipeWins may suspend or terminate any account at any time, with or without cause, including for violations of these Terms.
SnipeWins offers a free trial of approximately ten (10) minutes of full Service access per registered email address. The trial begins when you click the verification link we email to you and ends ten minutes later. After the trial ends, continued access requires a paid subscription. Multiple trials per person, household, or payment instrument are prohibited; SnipeWins reserves the right to deny trial access at our sole discretion.
SnipeWins offers paid subscription plans, including an annual plan and a monthly plan. Current pricing is displayed on the Service and may be updated from time to time. By subscribing, you authorize SnipeWins (through our third-party payment processor, Stripe, Inc.) to charge your payment method for the applicable subscription fees plus any applicable taxes.
Your subscription will automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. You may cancel at any time through the account management area of the Service, which links to a billing portal hosted by Stripe.
The monthly subscription plan includes a 7-day free trial during which no charge is made if the subscription is cancelled. If the subscription is not cancelled before the 7-day trial period ends, the monthly subscription fee will be charged.
Except where required by law, all subscription fees are non-refundable. Cancellation stops future renewals; it does not generate a refund for the current billing period. Partial-month or partial-year refunds are not provided.
SnipeWins may change subscription prices at any time. Changes will not affect your current billing cycle. If we change prices, we will provide notice at least thirty (30) days before the change takes effect for your next renewal.
You may cancel your subscription at any time by clicking "Manage Subscription" within your SnipeWins account and following the prompts in the Stripe billing portal, or by emailing hello@snipewins.com. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that period ends.
This section is the most important part of these Terms. Please read it carefully.
All market values ("MVs"), comparable-sale figures ("comps"), target bid amounts, "STRIKE" indicators, "Steals" recommendations, "Recommended Offers," and any other pricing or recommendation data displayed by the Service are estimates derived from publicly available data, primarily eBay sold-listing history. These estimates are produced by automated software and may be inaccurate, incomplete, or out of date for any number of reasons, including but not limited to:
SnipeWins does not guarantee the accuracy, completeness, currentness, or fitness for any particular purpose of any market value, target bid, recommendation, or other figure produced by the Service. SnipeWins makes no representation that following any target bid or recommendation will result in a profit, a successful purchase, a winning auction, or any specific outcome.
You alone are responsible for any bid, purchase, offer, or other transaction you place on eBay or any other platform. SnipeWins does not place bids, submit offers, or execute any transactions on your behalf. The Service is an information and analysis tool only. Every decision to bid, the amount you bid, when you bid, and whether to follow any SnipeWins recommendation is your decision and your responsibility. If you bid an amount and lose money on the resulting purchase, that loss is yours; SnipeWins is not liable for any such loss.
Nothing displayed by the Service constitutes investment advice, financial advice, or a solicitation to buy or sell any item. Sports trading cards are speculative collectibles whose value can rise, fall, or go to zero. Past performance of any card or market segment is not indicative of future results. You should consult a licensed financial advisor before treating sports card purchases as investments.
SnipeWins provides no tax advice. You are solely responsible for any tax consequences of your card purchases or sales, including reporting obligations and the determination of cost basis.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SNIPEWINS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE.
WITHOUT LIMITING THE FOREGOING, SNIPEWINS DOES NOT WARRANT THAT: the Service will be uninterrupted, timely, secure, or error-free; the information, market values, target bids, or other data provided will be accurate, complete, current, or reliable; defects or errors in the Service will be corrected; the Service will meet your requirements or expectations; or any results obtained from using the Service will be accurate or reliable.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SNIPEWINS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:
SnipeWins' total cumulative liability to you for any and all claims arising from or related to the Service shall not exceed the greater of (a) the amount you have paid to SnipeWins in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100.00). This limitation applies regardless of the legal theory on which the claim is based and even if SnipeWins has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless SnipeWins, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: your use of or access to the Service; your violation of these Terms; your violation of any third-party right; your bids, purchases, sales, offers, or transactions on eBay or any other marketplace; your violation of any applicable law; or any claim that your use of the Service caused harm to a third party.
You agree not to: use the Service for any unlawful purpose or in violation of these Terms; resell, sublicense, or commercially redistribute access to the Service; use automated tools (bots, scrapers, scripts) to access the Service in ways not expressly authorized; reverse engineer, decompile, or attempt to extract the source code of the Service; interfere with or disrupt the Service or servers; impersonate another person or entity; use the Service to violate eBay's Terms of Service, including unauthorized automated bidding; or use the Service to harass, defame, or harm any other user or third party.
SnipeWins reserves the right to suspend or terminate your account for any violation of this Section, with or without notice.
SnipeWins and its licensors own all right, title, and interest in and to the Service, including all software, content, layouts, designs, trademarks, logos, and other intellectual property. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only. All rights not expressly granted are reserved.
"SnipeWins" and the SnipeWins logo are trademarks of 5 Star Card Shop LLC. Other names, logos, and trademarks referenced on the Service are the property of their respective owners. Reference to a third-party trademark does not imply endorsement, sponsorship, or affiliation.
The Service integrates with and relies on third-party services, including eBay Inc.'s Browse API, Stripe Inc. for payment processing, Resend for transactional email, and Google LLC for optional sign-in. Your use of those services is subject to their own terms and privacy policies. SnipeWins is not responsible for the practices, content, or availability of any third-party service. The Service may contain links to third-party websites; SnipeWins does not endorse and is not responsible for their content, practices, or policies.
You may add, mark, or annotate snipes and related notes within the Service ("User Content"). You retain ownership of your User Content. By submitting User Content to the Service, you grant SnipeWins a non-exclusive, royalty-free, worldwide license to host, store, and display your User Content as necessary to provide the Service to you. You represent and warrant that your User Content does not infringe any third-party rights and is not unlawful, defamatory, or harmful.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of information as described in the Privacy Policy.
By creating an account, you consent to receive transactional email from SnipeWins, including account verification, password reset, billing receipts, security notices, and similar messages. These communications are necessary to operate the Service and cannot be opted out of without closing your account.
If you opted in during signup (the pre-checked "Daily eBay briefings and SnipeWins alerts" checkbox), you also consent to receive product-related email such as daily auction briefings, target-bid alerts, and product updates. You may opt out of these product communications at any time by clicking the unsubscribe link in any such email or by adjusting your account settings.
SnipeWins may modify, suspend, or discontinue all or any part of the Service at any time, with or without notice and with or without liability. We may impose limits on certain features or restrict access to portions of the Service without notice or liability.
SnipeWins may revise these Terms from time to time. The "Last Updated" date at the top of this document reflects the date of the most recent revision. Material changes will be communicated to registered users via email or a prominent notice within the Service at least fifteen (15) days before they take effect. Your continued use of the Service after a revision takes effect constitutes your acceptance of the revised Terms.
SnipeWins may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms, suspected fraud, abusive behavior, or non-payment. Upon termination, your right to access the Service ends immediately. Sections 7, 8, 9, 10, 12, 17, 18, 20, and 21 of these Terms shall survive termination. You may terminate your account at any time by cancelling your subscription and contacting hello@snipewins.com to request account deletion.
These Terms are governed by and construed in accordance with the laws of the State in which 5 Star Card Shop LLC is organized, without regard to its conflict-of-laws principles. Subject to Section 21 (Dispute Resolution), the exclusive venue for any judicial action arising from or related to these Terms shall be the state or federal courts located in that state, and you consent to the personal jurisdiction of those courts.
Before filing any claim, you agree to first attempt to resolve the dispute informally by emailing hello@snipewins.com with a description of the claim. SnipeWins and you agree to negotiate in good faith for at least thirty (30) days before any party initiates formal proceedings.
Except for disputes that qualify for small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted by a single arbitrator, by telephone or video conference or in the county where 5 Star Card Shop LLC maintains its principal place of business. The arbitrator's decision will be final and binding.
YOU AND SNIPEWINS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
You may opt out of this arbitration agreement by sending written notice to hello@snipewins.com within thirty (30) days of first accepting these Terms.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and SnipeWins regarding the Service and supersede all prior agreements. If any provision is held invalid or unenforceable, the remaining provisions remain in full force. SnipeWins' failure to enforce any right is not a waiver. You may not assign these Terms without SnipeWins' prior written consent; SnipeWins may assign without restriction. SnipeWins is not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, internet outages, third-party API failures, or governmental actions.
